9. If You or Your Authorized Person Disagree with the Transactions Recorded in Your Account Statement

 If you (or your authorized person) disagree with the transactions reflected in your account statement, you should turn to the Bank within 45 (forty five) days, complete a relevant application-complaint indicating the cause of your complaint. Based on your application, the Bank will undertake measures in order to clarify the disputed transactions in accordance with the current RA legislation and the rules of the VISA or MasterCard payment systems.

The filled in application may be complemented with any proof supporting the disputed transaction amount. It should be noted that in the case of absence within 45 (forty five) days of any objections to the transactions, all transactions will be deemed duly performed. The Bank will not be held responsible for the trustworthiness of any transactions reflected in your account statement in case of late submission of your objections The Bank will not be held liable for the delayed request of the Customer for a monthly account statement.

A means of resolving disputed matter is the electronic message received from VISA or MasterCard payment systems in response to the relevant inquiry; the hard copy of which is provided by the Bank to the Customer. Upon the request of the Customer, the Bank furnishes the Customer with a document certifying the authenticity of the transaction, along with charging a commission fee set for the relevant service.

The amount disputed by you or your authorized person is entered to the card account in the amount confirmed by the data of VISA and MasterCard payment systems. In the case the Parties fail to settle the dispute by means of negotiations, these matters are subject to resolution through court procedure pursuant to the RA legislation.
